These Terms of Service (“Terms”) form a legally binding agreement between you and Cinematic Autobiography governing access to our website, mobile applications, and related services.
By creating an account, accessing, or using the Service, you agree to these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree, you must not use the Service.
You must be at least 16 years old and have the legal capacity to enter into these Terms.
Cinematic Autobiography helps users preserve family stories through documentary-style films. The Service includes:

You may not create accounts with false information, create multiple accounts for abusive purposes, or use another person’s account without permission.
The Service offers one-time purchases and recurring subscription plans. Pricing, features, and billing frequency are shown at purchase and on the pricing page.
Recurring subscriptions renew automatically at the end of each billing cycle unless cancelled before renewal. We will notify you of price changes at least 30 days before they take effect.
Payments are processed securely through Stripe. By providing payment information, you authorize the applicable charges and remain responsible for taxes. Prices include VAT or sales tax where required by law.
You may cancel through account settings. Upon cancellation:
We may offer free trials. At the end of a trial, the subscription converts to a paid plan unless you cancel before the trial expires.
EU or EEA consumers may have a 14-day withdrawal right starting from purchase under EU consumer law.
To exercise this right, send a clear withdrawal statement to support@cinematicautobiography.com. Refunds will be processed within 14 days of receiving the notice using the original payment method.
If you expressly consent to receiving digital content during the withdrawal period and acknowledge that the right is lost, the cooling-off period may not apply to that content.

Purchases through the Apple App Store or Google Play Store are subject to the refund policies of those platforms.
You retain ownership of content you upload, record, or create through the Service, including recordings, photos, family tree data, and biographical information.
You grant Cinematic Autobiography a non-exclusive, revocable, worldwide license to use, process, store, and display Your Content only to provide, improve, and deliver the Service.
The license ends when you delete content or close your account, except where legal retention applies. We do not use Your Content for advertising or model training.
The Service design, code, features, trademarks, logos, and other intellectual property are owned by or licensed to Cinematic Autobiography.
Music tracks and AI-generated elements are licensed for personal, non-commercial use as part of the Service unless a separate commercial license applies.
The Service lets you create or join family groups to collaborate on family stories and documentaries. Group members may access shared content according to permissions you configure.
Family group creators are responsible for managing membership and permissions and should invite only people with a legitimate connection to the stories being preserved.
When a family group creator deletes an account, family-scoped data may be affected:

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CINEMATIC AUTOBIOGRAPHY AND ITS PERSONNEL ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
Our total liability for claims relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim or $100.
Nothing excludes liability for death or personal injury caused by negligence, fraud, or other liability that cannot be excluded by law.
You agree to defend, indemnify, and hold harmless Cinematic Autobiography and its personnel from claims, damages, losses, liabilities, costs, or expenses arising from:

If informal resolution fails, either party may start mediation through a mutually agreed mediator. Mediation costs are shared equally.
If mediation fails, disputes may be resolved through binding arbitration or courts of competent jurisdiction. Specific jurisdiction remains subject to legal counsel review.
If you are an EU consumer, you may use competent national consumer dispute resolution bodies or other consumer redress channels available in your country. This does not affect your right to bring proceedings in the courts of the EU member state where you reside.
To the extent permitted by law, disputes will be resolved individually and not as part of a class, consolidated, or representative action.
These Terms are governed by the laws of the jurisdiction to be determined by legal counsel, without regard to conflict-of-law rules.
EU consumers retain the benefit of mandatory protections under the laws of their country of residence.
We are not liable for failure or delay caused by circumstances beyond our reasonable control, including natural disasters, pandemics, war, terrorism, civil unrest, government action, labor disruption, infrastructure failures, or telecommunications and information-system failures.
If any provision of these Terms is invalid, illegal, or unenforceable, the remaining provisions remain in effect. The invalid provision will be modified as little as necessary to make it valid and enforceable while preserving the original intent.
These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Cinematic Autobiography regarding the Service and supersede prior agreements and understandings.
We may modify these Terms from time to time. For material changes, we will:
