1. Agreement to Terms

These Terms of Service (“Terms”) form a legally binding agreement between you and Cinematic Autobiography governing access to our website, mobile applications, and related services.

By creating an account, accessing, or using the Service, you agree to these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree, you must not use the Service.

You must be at least 16 years old and have the legal capacity to enter into these Terms.

2. Service Description

Cinematic Autobiography helps users preserve family stories through documentary-style films. The Service includes:

• Interview recording: Tools for recording guided audio and video interviews on your device.
• AI-powered processing: Automated transcription, audio enhancement, narrative extraction, photo animation, music scoring, and video assembly.
• Documentary creation: Assembly of interviews, photos, and generated elements into documentary films.
• Family tree management: Tools for building and visualizing family trees with biographical data and photographs.
• Streaming and delivery: Streaming access to completed documentaries through the Service.
• Partner network: Access to professional studios and filmmakers for premium production services.

Available features depend on your plan or purchase. We may modify, suspend, or discontinue parts of the Service with reasonable notice.

3. Account Registration and Security

To use most features, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update account information
• Keep account credentials secure
• Accept responsibility for activity under your account
• Notify us immediately of unauthorized access or use

You may not create accounts with false information, create multiple accounts for abusive purposes, or use another person’s account without permission.

4. Subscriptions, Purchases, and Billing

4.1 Subscription Plans

The Service offers one-time purchases and recurring subscription plans. Pricing, features, and billing frequency are shown at purchase and on the pricing page.

4.2 Auto-Renewal

Recurring subscriptions renew automatically at the end of each billing cycle unless cancelled before renewal. We will notify you of price changes at least 30 days before they take effect.

4.3 Billing

Payments are processed securely through Stripe. By providing payment information, you authorize the applicable charges and remain responsible for taxes. Prices include VAT or sales tax where required by law.

4.4 Cancellation

You may cancel through account settings. Upon cancellation:

• Access remains active until the end of the current billing period
• You will not be charged for later billing periods
• You retain access to content created during your subscription
• Partial refunds are not provided except as required by law

4.5 Free Trial

We may offer free trials. At the end of a trial, the subscription converts to a paid plan unless you cancel before the trial expires.

5. Refund Policy

5.1 EU Consumer Right of Withdrawal

EU or EEA consumers may have a 14-day withdrawal right starting from purchase under EU consumer law.

To exercise this right, send a clear withdrawal statement to support@cinematicautobiography.com. Refunds will be processed within 14 days of receiving the notice using the original payment method.

If you expressly consent to receiving digital content during the withdrawal period and acknowledge that the right is lost, the cooling-off period may not apply to that content.

5.2 General Refund Policy

Outside the EU cooling-off period, refund requests are reviewed case by case. Refunds may be issued for:

• Unresolved technical failures preventing delivery
• Duplicate charges caused by billing errors
• Service not substantially as described at purchase

To request a refund, contact support@cinematicautobiography.com within 30 days of the charge and include your account email and reason.

5.3 Apple App Store and Google Play Purchases

Purchases through the Apple App Store or Google Play Store are subject to the refund policies of those platforms.

6. Content Ownership and Licensing

6.1 Your Content

You retain ownership of content you upload, record, or create through the Service, including recordings, photos, family tree data, and biographical information.

6.2 License to Us

You grant Cinematic Autobiography a non-exclusive, revocable, worldwide license to use, process, store, and display Your Content only to provide, improve, and deliver the Service.

• Processing recordings through the AI pipeline
• Storing content on our infrastructure and processors
• Streaming completed documentaries to authorized viewers
• Creating thumbnails and previews for your media library

The license ends when you delete content or close your account, except where legal retention applies. We do not use Your Content for advertising or model training.

6.3 Our Content

The Service design, code, features, trademarks, logos, and other intellectual property are owned by or licensed to Cinematic Autobiography.

6.4 Music and AI-Generated Elements

Music tracks and AI-generated elements are licensed for personal, non-commercial use as part of the Service unless a separate commercial license applies.

7. Family Groups and Shared Data

7.1 Family Groups

The Service lets you create or join family groups to collaborate on family stories and documentaries. Group members may access shared content according to permissions you configure.

7.2 Family Creator Responsibilities

Family group creators are responsible for managing membership and permissions and should invite only people with a legitimate connection to the stories being preserved.

7.3 Account Deletion and Family Data

When a family group creator deletes an account, family-scoped data may be affected:

• Family members are notified of the deletion request
• A 30-day grace period keeps the account and data intact
• Family members may download their contributed content during the grace period
• Another family member may be designated as group creator
• If no new creator is designated, shared family data may be deleted
• Individual content from other members remains in their own accounts

8. Acceptable Use Policy

You agree not to use the Service to:

• Upload or create illegal, harmful, abusive, defamatory, obscene, or otherwise objectionable content
• Impersonate a person or misrepresent an affiliation
• Infringe intellectual property, privacy, or other third-party rights
• Depict or promote violence, exploitation, or abuse
• Use the Service commercially without authorization
• Attempt unauthorized access to the Service, accounts, or systems
• Reverse engineer or attempt to derive source code
• Introduce malware or harmful code
• Use bots, scrapers, or crawlers without written consent
• Circumvent technical protections
• Misuse AI features outside legitimate family storytelling
• Violate applicable law

We may remove content and suspend or terminate accounts that violate this policy.

9. Account Suspension and Termination

9.1 Termination by You

You may delete your account through account settings or by contacting support@cinematicautobiography.com.

Upon deletion, your data will be handled according to our Privacy Policy.

9.2 Termination or Suspension by Us

We may suspend or terminate your account if:

• You violate these Terms or the Acceptable Use Policy
• Your account shows signs of fraud
• You fail to pay fees after reasonable notice
• We are required to act by law or court order
• Your use risks the security or integrity of the Service or other users

Where possible, we provide notice and an opportunity to remedy. Severe violations or imminent harm may require immediate action.

9.3 Effect of Termination

• Access to the Service ceases immediately
• Outstanding fees become due
• Data is retained and deleted according to the Privacy Policy
• Sections that should survive termination remain effective

10. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND.

We do not warrant that:

• The Service will be uninterrupted, timely, secure, or error-free
• AI processing results will be accurate or meet expectations
• Defects will be corrected within a specific timeframe
• The Service will be compatible with all devices and operating systems

This disclaimer does not affect statutory consumer rights that cannot be excluded or limited by applicable law.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CINEMATIC AUTOBIOGRAPHY AND ITS PERSONNEL ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

• Access to, use of, or inability to use the Service
• Third-party conduct or content on the Service
• Content obtained from the Service
• Unauthorized access, use, or alteration of transmissions or content
• Loss or corruption of uploaded content, recordings, or documentary files

Our total liability for claims relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim or $100.

Nothing excludes liability for death or personal injury caused by negligence, fraud, or other liability that cannot be excluded by law.

12. Indemnification

You agree to defend, indemnify, and hold harmless Cinematic Autobiography and its personnel from claims, damages, losses, liabilities, costs, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of third-party rights
• Content you upload or create through the Service

This obligation does not apply where prohibited by consumer protection law.

13. Copyright and DMCA

We respect intellectual property rights and expect users to do the same. If you believe content on the Service infringes your copyright, send a notice containing:

• A description of the copyrighted work
• A description of where the allegedly infringing material appears
• Your contact information
• A good-faith statement that the use is unauthorized
• A statement that the notice is accurate and you are the owner or authorized to act
• Your physical or electronic signature

We will investigate alleged infringement and take appropriate action under the DMCA and applicable copyright laws.

14. Dispute Resolution

14.1 Informal Resolution

Before formal dispute resolution, first contact us at support@cinematicautobiography.com and try to resolve the issue informally for at least 30 days.

14.2 Mediation

If informal resolution fails, either party may start mediation through a mutually agreed mediator. Mediation costs are shared equally.

14.3 Arbitration or Litigation

If mediation fails, disputes may be resolved through binding arbitration or courts of competent jurisdiction. Specific jurisdiction remains subject to legal counsel review.

14.4 EU Consumer Redress

If you are an EU consumer, you may use competent national consumer dispute resolution bodies or other consumer redress channels available in your country. This does not affect your right to bring proceedings in the courts of the EU member state where you reside.

14.5 Class Action Waiver

To the extent permitted by law, disputes will be resolved individually and not as part of a class, consolidated, or representative action.

15. Governing Law

These Terms are governed by the laws of the jurisdiction to be determined by legal counsel, without regard to conflict-of-law rules.

EU consumers retain the benefit of mandatory protections under the laws of their country of residence.

16. Force Majeure

We are not liable for failure or delay caused by circumstances beyond our reasonable control, including natural disasters, pandemics, war, terrorism, civil unrest, government action, labor disruption, infrastructure failures, or telecommunications and information-system failures.

17. Severability

If any provision of these Terms is invalid, illegal, or unenforceable, the remaining provisions remain in effect. The invalid provision will be modified as little as necessary to make it valid and enforceable while preserving the original intent.

18. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Cinematic Autobiography regarding the Service and supersede prior agreements and understandings.

19. Changes to These Terms

We may modify these Terms from time to time. For material changes, we will:

• Provide at least 30 days’ notice before changes take effect
• Notify you by email or a prominent notice in the Service
• Update the “Last updated” date on this page

Continued use after the notice period constitutes acceptance of the modified Terms. If you do not agree, you must stop using the Service and may cancel your account.

Changes required by law or that do not materially affect your rights may take effect without the 30-day notice period.
